Terms of Service

1. Acceptance of Terms
By accessing or using NativCoach ("the Platform"), you ("Coach" or "User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. These Terms constitute a legally binding agreement between you and NativCoach LLC.
2. Description of Service
NativCoach provides a SaaS (Software as a Service) business management platform for coaching professionals. Features include client CRM, scheduling, digital contracts, payment processing, team management, white-label website and client portal, messaging, intake forms, session notes, Zoom integration, Google Calendar sync, white-label email, custom website domains, and digital business cards. The Platform is provided on a subscription basis and is fully white-labeled — your clients interact with your brand, not ours.
3. Account Registration
- You must be at least 18 years old to create an account.
- You are responsible for maintaining the security of your account credentials.
- You must provide accurate and complete registration information.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately of any unauthorized use of your account.
4. Free Trial & Subscription Plans
Free Trial: New accounts receive a 30-day free trial with full platform access — all features unlocked, no credit card required. At the end of your trial, choose the plan that fits your business.
Paid Plans: After the trial period, continued access requires a paid subscription. All plans are billed monthly in advance.

You may cancel at any time; access continues until the end of the current billing period. All payments are processed by Stripe. Annual pricing options may be available — contact us for details.
Digital Business Cards are available as an optional add-on for all plan tiers at an additional monthly fee. Features include full profile customization, lead capture form, QR code, Save to Home Screen, and Apple/Google Wallet pass.
5. Platform Transaction Fee
A 0.5% platform processing fee applies to all client payments collected through NativCoach (i.e., payments your clients make to you via the platform's payment features). This fee is separate from and in addition to Stripe's standard payment processing fee (currently 2.9% + $0.30 per transaction, charged directly by Stripe). The platform fee covers the infrastructure costs of payment routing, Stripe Connect integration, and fund disbursement services.
This fee is automatically deducted before funds are transferred to your connected Stripe account. NativCoach does not receive Stripe's processing fee — that fee is paid to Stripe directly.
The platform transaction fee does not apply to your NativCoach subscription payments, which are billed at the flat monthly rates shown above.
6. Refund Policy
Subscription fees are non-refundable except where required by law. If you cancel, your account remains active through the end of the paid period. We do not provide prorated refunds for partial months.
If you experience a technical issue that prevents platform access, contact us at [email protected] and we will work to resolve it or issue appropriate credit.
7. Acceptable Use
You agree not to use NativCoach to:
- Violate any applicable laws or regulations
- Harass, abuse, or harm another person
- Send unsolicited commercial messages (spam)
- Upload malicious code, viruses, or harmful content
- Attempt to gain unauthorized access to the Platform or other accounts
- Scrape, reverse-engineer, or copy the Platform
- Resell or sublicense the Platform without written permission
- Use the Platform for any purpose that is deceptive, fraudulent, or illegal
Violation of these terms may result in immediate account termination without refund.
8. Your Data & Content
You retain ownership of all data you enter into NativCoach (client records, documents, session notes, media, and other content). By using the Platform, you grant NativCoach a limited, non-exclusive license to store, process, and transmit your data solely for the purpose of providing and improving the service.
You are solely responsible for the legality and accuracy of data you enter, including obtaining proper consent from your clients to store their personal information on your behalf. You must comply with all applicable privacy laws (including GDPR, CCPA, and HIPAA if applicable to your practice).
Upon account termination, you may request an export of your data within 30 days. After that period, data may be permanently deleted.
9. Third-Party Services & Data Processors
NativCoach integrates with the following third-party services to deliver platform functionality. By using NativCoach, you acknowledge that your data may be processed by these providers in accordance with their respective privacy policies and terms.

Stripe
Payment processing for coach subscriptions and client-to-coach payments via Stripe Connect. Stripe stores and processes payment card data. NativCoach never stores raw card numbers. Stripe's standard fee (2.9% + $0.30 per transaction) is charged directly by Stripe and deducted before funds reach your account.

Zoom
Video conferencing for coaching sessions. When you connect your Zoom account, NativCoach can create and manage meetings on your behalf. If you enable Zoom Cloud Recording, recording links are automatically saved to your session records on NativCoach. Zoom meeting data and recordings are governed by Zoom's privacy policy.

Google Calendar
Optional calendar sync for coaches on Pro and Agency plans. When connected, NativCoach reads and writes events on your Google Calendar. Google Calendar access uses OAuth 2.0 and can be revoked at any time from your Google account settings or from Dashboard → Integrations.

Cloudflare
NativCoach uses Cloudflare for CDN, DDoS protection, and custom website domain provisioning (Cloudflare for SaaS). Coaches on Pro and Agency plans who connect a custom domain authorize NativCoach to provision a custom hostname on Cloudflare's network. All web traffic may pass through Cloudflare's infrastructure.

Resend
Transactional email delivery for all platform emails (booking confirmations, contract notifications, client portal invitations, etc.). Coaches on Pro and Agency plans may connect a custom sending domain — this routes your outbound emails through Resend's infrastructure under your domain name. Resend processes email metadata and content to deliver messages.

Fathom
Fathom is an optional third-party AI meeting recorder (fathom.video). NativCoach does not control or operate Fathom. If you use Fathom during Zoom sessions, you may configure Fathom to send meeting summaries to your unique NativCoach inbound email address. When received, those summaries are saved to your session records. Any data Fathom collects during your meetings is governed solely by Fathom's privacy policy.

Sentry
Error and performance monitoring. When errors occur on the platform, diagnostic information (stack traces, request metadata) may be sent to Sentry to help us identify and fix bugs. No client payment data is included in error reports.

10. Recording & AI Notes Consent
If you use Zoom Cloud Recording or Fathom AI during coaching sessions, you are solely responsible for:
- Obtaining your client's informed consent before recording any session
- Complying with all applicable laws regarding recording of conversations in your jurisdiction
- Informing clients that AI-powered note-taking tools may be active during sessions
- Storing and sharing recordings only in accordance with your client agreements and applicable law
NativCoach provides the infrastructure to store and display recording links and AI-generated summaries but is not responsible for the legality of recordings made through third-party tools.
11. Intellectual Property
NativCoach and its associated logos, platform design, features, and software are the intellectual property of NativCoach LLC. These Terms do not grant you any right to use our trademarks, logos, or other proprietary materials.
The white-label branding you configure on the platform (your logo, colors, domain) remains your intellectual property. NativCoach does not claim ownership over your brand assets.
12. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. NATIVCOACH DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NATIVCOACH LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF REVENUE, LOSS OF DATA, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM.
14. Termination
Either party may terminate this agreement at any time. We may suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or use the Platform in a manner that creates legal risk for NativCoach or other users. Upon termination, you may request an export of your data within 30 days.
15. Governing Law & Disputes
These Terms are governed by the laws of the United States and the state in which NativCoach LLC is incorporated, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration administered under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property matters.
16. Changes to Terms
We may update these Terms at any time. We will notify you of material changes at least 14 days in advance via email. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
